§ 12a. Customer content, moderation and notices
- The Service Provider stores the content entered by the Customer into the Application (customer data, orders, recipes, products, documents, attachments and other) solely at the Customer's request and does not make it publicly available. The Service Provider does not review this content on its own initiative and does not use automated tools to assess its compliance with the law or the Terms of Service.

§ 13. Liability and service level
The Service Provider strives for Application availability of at least 99% on a monthly basis. The Service Provider's liability towards Entrepreneurs is limited to the value of the Fees paid during the last 12 months. The Service Provider is not liable for the effects of force majeure, errors resulting from improper use, interruptions on the part of infrastructure providers or errors of external systems (Fakturownia, KSeF, the payment operator).
§ 14. Intellectual property
The BakePilot Application, its code, interface, logos and trademarks are the property of the Service Provider protected by copyright. Upon conclusion of the Agreement, the Service Provider grants the Customer a non-exclusive license to use the Application within the scope of an active Subscription. The license expires upon termination of the Agreement. Any form of reverse engineering or copying of the Application without the written consent of the Service Provider is prohibited.
§ 15. Personal data and entrustment of processing
The controller of the Customers' personal data is the Service Provider (KamikStudio, Patryk Kowalski). The detailed rules are set out in the Privacy Policy.
With regard to the data of the Organization's customers (first names, surnames, addresses, phone numbers), the Service Provider acts as a data processor (Article 28 GDPR, Regulation (EU) 2016/679) - the Customer remains the controller. Acceptance of the Terms of Service constitutes the conclusion of a Data Processing Agreement (DPA). On request, the full text of the DPA is available at kontakt@bakepilot.pl.
Subprocessors: Supabase Inc. (database), Vercel Inc. (hosting), Resend Inc. (e-mail), Easy.tools sp. z o.o. (until 19.10.2026 - handling of subscriptions concluded before 21.09.2026, including payments and invoices issued on behalf of the Service Provider), Stripe Payments Europe, Ltd. (card payments and subscription handling), Fakturownia sp. z o.o. (issuing invoices and sending them to KSeF), Meta Platforms Ireland Ltd. (remarketing), Functional Software Inc. / Sentry (error monitoring), Anthropic PBC (reading documents uploaded to the invoice price scanner), Cloudflare, Inc. (protection of the registration, comment and notice forms against bots - Cloudflare Turnstile) - all on the basis of standard contractual clauses (SCC) or national provisions. The current list is available in the Privacy Policy and on the GDPR page.
If the Customer uses the Working time module, the entrustment also covers the data of the Organization's employees (working time records, absences, data necessary for payroll). The Customer, as the employer, remains the controller of this data.
§ 15a. Remote technical support access
In order to diagnose and resolve reported technical problems, the Service Provider may obtain remote access to the data of the Customer's Organization in the Application. Access is possible only when all of the following conditions are met:
- The Customer has created a ticket in the technical support system (the “Help” widget in the Application).
- The Customer has given express consent to access by clicking the “I consent to account access” button in the ticket window. Consent is given separately for each ticket.
- The access session lasts a maximum of 24 hours from the moment it is started and expires automatically.
As part of remote access, the Service Provider may view and edit the Organization's data (orders, products, recipes, ingredients, customers, settings) to the extent necessary to resolve the ticket. All actions performed by the Service Provider during the session are recorded in the event log (audit log).
The Customer may withdraw consent at any time by clicking the “Revoke” button in the ticket window. Withdrawal of consent immediately ends the active access session.
§ 16. Invoicing and KSeF
VAT invoices for the Subscription are issued in the Fakturownia system (Fakturownia sp. z o.o.) and, in cases required by law, sent to the National e-Invoicing System (KSeF). The KSeF number is given in the e-mail with the invoice. Invoices are delivered only in electronic form (PDF). Subscriptions paid through Easy.tools before 21.09.2026 are settled until the end of the paid period, no later than 19.10.2026, with invoices issued by the Easy.tools system. The Customer is obliged to provide up-to-date company details (NIP, address) when paying.
§ 16a. Customer integration with KSeF
The Application allows the Customer to connect their own account with the National e-Invoicing System: issuing a KSeF certificate, sending sales invoices and downloading purchase invoices issued to the Customer's NIP number. The Service Provider acts solely as a technical tool transmitting data to and from KSeF on behalf of the Customer.
The Customer is responsible for holding the authorizations to act in KSeF on behalf of their entity, for the correctness and completeness of the data on the documents issued and for the timely fulfillment of obligations arising from the e-invoicing regulations. The certificate and the associated key are stored in encrypted form and used solely to perform the functions of the Application.
The Service Provider is not liable for unavailability, errors or changes on the part of KSeF, including rejection of a document by that system, or for the consequences of the Customer lacking or losing authorizations in KSeF.
§ 16b. Nature of tax and financial data
Application features presenting tax calculations, in particular the Finance module (VAT estimate), are solely auxiliary and informational. They serve to plan financial liquidity and do not constitute a tax return, a tax book, records within the meaning of tax regulations, or tax or accounting advice.
The calculations are based on data entered by the Customer and may be incomplete if this data is incomplete. The Service Provider does not provide tax advisory services within the meaning of the Tax Advisory Act (ustawa o doradztwie podatkowym). Only the Customer and their accountant are responsible for the correctness of tax settlements, returns filed and books kept.
§ 17. Out-of-court dispute resolution
A Consumer may use out-of-court methods of handling complaints and pursuing claims, in particular the assistance of the provincial inspector of the Trade Inspection (Inspekcja Handlowa), a permanent consumer arbitration court or another entity entered in the register of entities authorized to conduct out-of-court consumer dispute resolution proceedings, kept by the President of UOKiK (the Polish Office of Competition and Consumer Protection) (uokik.gov.pl). A Consumer may also seek assistance from a municipal or district consumer ombudsman. Use of these procedures is voluntary.
§ 18. Amendment of the Terms of Service
The Service Provider reserves the right to amend the Terms of Service for important reasons (change in the law, the scope of the Service, security considerations). The Customer is informed of the changes by e-mail at least 14 days before they enter into force. Failure to terminate the Agreement within this period is equivalent to acceptance of the new Terms of Service. The changes do not affect paid Subscription Periods.
§ 19. Changes to the Service
The Service Provider may make changes to the Application (new features, modifications, removals). The Customer is informed of material changes negatively affecting the Service at least 14 days in advance. If a change materially and negatively affects the use of the Service, the Customer may terminate the Agreement within 30 days without additional costs.
§ 20. Final provisions
In matters not regulated herein, the provisions of Polish law apply (the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act, the GDPR, copyright law). Disputes with Consumers are resolved by the court having jurisdiction under the Code of Civil Procedure (Kodeks postępowania cywilnego); disputes with Entrepreneurs are resolved by the court having jurisdiction for the Service Provider's registered office (Kalisz). The invalidity of one provision does not affect the others. The Terms of Service are in force from 27 March 2026.
