§ 1. Definitions
- Service Provider - Patryk Kowalski, running a business under the name KamikStudio Patryk Kowalski, NIP (Polish tax identification number) 6182187584, the provider of the BakePilot application.
- Bakery - an entrepreneur using the BakePilot application under the Terms of Service (referred to in the Terms of Service as the “Customer”), who invites its customers to the portal.
- Customer - a company buying from the Bakery (the Bakery's wholesale customer).
- User - a person acting on behalf of the Customer who has accepted the invitation and created an account in the portal.
- Portal - the service at zamowienia.bakepilot.pl, in which the User browses products and prices set by the Bakery for the Customer and sends orders.
§ 2. Nature of the portal
- The portal is the Bakery's tool for receiving orders from Customers. The sales contract is concluded solely between the Customer and the Bakery; its terms (prices, payments, deliveries, complaints about goods) are set by the Bakery.
- An order sent in the portal is a request for the order to be accepted. It becomes binding only once the Bakery accepts it; until then its status is “Awaiting confirmation”. The Bakery may reject the order, giving a reason.
- Prices in the portal come from the Bakery's price list assigned to the Customer, on the day selected as the pickup date. The value shown when sending is indicative - when the order is accepted, prices are recalculated and the final prices can be seen in the order accepted by the Bakery.
§ 3. Account
- An account can be created only from the link in the invitation from the Bakery. The link is valid for 7 days and works once.
- The account is personal. The User does not share the password with other people; each person from the Customer's company may receive their own invitation.
- People from one Customer company see that company's orders, including those placed with the Bakery by phone, with information on who placed the order in the portal. Customers do not see one another.
- The Bakery may revoke the User's access at any time. The Service Provider may block the account in the event of a breach of these terms or a security threat.
§ 4. Placing and cancelling orders
- The earliest pickup date is the day following the day the order is sent.
- The delivery address is selected from the addresses set by the Bakery for the Customer; a different address can be entered in the order notes.
- An order can be cancelled in the portal as long as the Bakery has not accepted it. Changing or cancelling an accepted order is agreed directly with the Bakery.
- Sending fictitious orders or unlawful content and actions disrupting the operation of the portal are prohibited.
§ 5. Technical requirements and availability
To use the portal you need a device with internet access, an up-to-date web browser and an email address. The Service Provider makes every effort to keep the portal running without interruption; technical interruptions may result from maintenance work or outages of infrastructure providers.
§ 6. Liability
The Service Provider is responsible for the operation of the portal as a tool. The Bakery is responsible for fulfilling orders, the quality of goods, prices and terms of sale.
§ 7. Personal data
The controller of the User's data is the Bakery that sent the invitation. The Service Provider processes it on the Bakery's behalf. Details: information on personal data in the ordering portal.
§ 8. Complaints about the portal
Complaints about the operation of the portal can be sent to kontakt@bakepilot.pl. The Service Provider replies within 14 days. Complaints about orders and goods should be addressed to the Bakery.
§ 9. Final provisions
- The terms apply from the day the portal is launched for the Bakery that invited the User.
- The Service Provider informs Users of a change to the terms by email at least 14 days before it takes effect.
- Polish law applies to matters not regulated herein.
